Legal Links - California AB 1068 AND AB 2868

These bills, recently signed into law, provide revisions to AB655 signed last year.

Under the new law, California employers must provide a check box on the disclosure or a separate written form where the applicant can indicate they wish to receive a copy of any investigative consumer report ordered on them (Click here to see the California Release Form in Adobe Acrobat .pdf format).

If the applicant requests a copy of the report, the report must be provided within 3 business days of receipt from the consumer reporting agency. The requirement to provide a cover sheet with the report has been eliminated.

Note: None of this affects the guidelines of the Fair Credit Reporting Act which must be adhered to when ordering background checks on applicants.
